These User Content Permission Terms, together with our Privacy Policy and general site Terms of Use, apply if you upload content, including but not limited to pictures, videos, reviews, testimonials or other materials, to our sites, hashtags, social pages, or if you agree to the PINX Nails Terms of Use, PINX Ambassador Program Terms, Content Usage Policy, Privacy Policy, or any related program terms by ticking a checkbox, creating an account, submitting a form, participating in a PINX Nails campaign, or otherwise providing content to PINX Nails.

These User Content Permission Terms provide your consent to PINX Nails, our related entities, affiliates, partners, agencies and third-party providers, collectively “PINX Nails,” as follows:

You grant PINX Nails a worldwide, royalty-free, non-exclusive, transferable right to use your video(s), photo(s), review(s), testimonial(s) and/or other content posted online, including but not limited to Instagram, TikTok, Facebook, YouTube, Pinterest, X, or any other platform, in addition to those you have tagged with #PINXNails, @pinxnails, or any PINX Nails campaign hashtag, together with your social media handle, social media user name, profile picture, caption and location information you may have included in your content (“User Content”) in any media, including but not limited to on its webpages, social media pages and other digital media, paid advertisements, newsletters, retailer sites, third-party sites, print materials, in-store materials, television and other broadcast media, for its marketing and/or advertising. PINX Nails may use, reproduce, modify, delete in its entirety, adapt, publish, translate, create derivative works, crop, edit, resize, add captions, add text, combine with other content, and otherwise use the User Content in any manner in its sole discretion.

You represent and warrant that you own all rights in and to the User Content, you have permission from any person(s) appearing in the User Content to grant the rights herein, and you are not a minor.

The User Content is a true and accurate expression of your honest belief based on use of PINX Nails products, and you have and will disclose receipt of any free product, payment, commission, affiliate benefit, discount, incentive, or any other benefit received in exchange for providing User Content.

You consent to PINX Nails’ collection of any personal information you provide, and PINX Nails’ use and disclosure of that personal information in connection with the use of your User Content as described above. Your personal information may be transferred to or accessible all over the world, and may be shared with affiliates, partners, agencies, advertising platforms, or other trusted third parties working on PINX Nails’ behalf. By posting User Content with any hashtag(s), tagging PINX Nails, submitting content to PINX Nails, creating an account, ticking a checkbox agreeing to the PINX Nails Terms of Use, PINX Ambassador Program Terms, Content Usage Policy, Privacy Policy, or otherwise providing PINX Nails with personal information, you agree to such collection, use, disclosure, transfer and processing of your information in accordance with these Permission Terms, PINX Nails’ Privacy Policy, and applicable data protection laws and regulations.

You hereby release, discharge and agree to hold PINX Nails and any person acting on PINX Nails’ behalf harmless from any liability related in any way with the User Content.
